These Terms of Service (“Terms”) govern your access to and use of the Mango Monkeyz website, online store, products, services and related features.

Throughout these Terms, the words “Mango Monkeyz,” “we,” “us” and “our” refer to Mango Monkeyz and/or the legal entity operating the Mango Monkeyz business, as applicable.

The words “you,” “your,” “customer” and “user” refer to any person accessing our website, creating an account, placing an order, purchasing a product or otherwise using our services.

By accessing our website, placing an order or purchasing from Mango Monkeyz, you agree to these Terms, together with our:

  • Privacy Policy;

  • Shipping Policy;

  • Return, Exchange & Refund Policy; and

  • any other policies displayed on our website.

If you do not agree to these Terms, please do not use our website or place an order.

Nothing in these Terms is intended to exclude or restrict any mandatory rights available to consumers under applicable Indian law.

1. ELIGIBILITY TO USE OUR STORE

By using our website or placing an order, you represent that you are legally competent to enter into the transaction or that the transaction is being made under the supervision/authority of a person legally competent to contract.

You agree not to use our products, website or services for any unlawful, fraudulent or unauthorised purpose.

2. ACCURACY OF INFORMATION PROVIDED BY YOU

You agree to provide current, complete and accurate information when placing an order, including your:

  • full name;

  • mobile number;

  • email address;

  • billing address;

  • delivery address; and

  • payment information where applicable.

You are responsible for checking the accuracy of the information supplied before completing your order.

Mango Monkeyz will not ordinarily be responsible for delivery failures or delays resulting from incorrect or incomplete information supplied by the customer.

Where permitted by law, additional shipping or handling costs resulting from incorrect customer-supplied information may be recoverable from the customer.

3. ORDER PLACEMENT DOES NOT ALWAYS GUARANTEE ACCEPTANCE

Submitting an order through our website does not prevent Mango Monkeyz from conducting reasonable payment, inventory, address, fraud or order verification.

We reserve the right, where reasonably necessary, to refuse, hold, verify or cancel an order before fulfilment for legitimate reasons including:

  • suspected fraud;

  • payment irregularities;

  • suspicious order behaviour;

  • inaccurate customer information;

  • unusually large quantities;

  • suspected unauthorised resale;

  • previous fraudulent activity;

  • repeated COD refusals;

  • inventory errors;

  • technical errors;

  • pricing errors;

  • coupon or promotional abuse; or

  • other circumstances reasonably indicating misuse of our website or services.

If we cancel a legitimate prepaid order after payment has been successfully collected, the applicable amount paid for the cancelled order will be refunded in accordance with our policies and applicable law.

4. ORDER VERIFICATION & ANTI-FRAUD CHECKS

To protect Mango Monkeyz and genuine customers from fraudulent transactions, certain orders may be subject to additional verification.

We may, where reasonably necessary, contact you through the contact details supplied with your order to verify information such as:

  • customer identity;

  • order details;

  • delivery address;

  • contact number;

  • payment status;

  • COD confirmation;

  • unusually large orders;

  • multiple orders;

  • previous delivery history; or

  • other information reasonably relevant to preventing fraud.

We may place an order on hold while such verification is being completed.

Failure to reasonably cooperate with necessary verification may result in cancellation of the order where we have reasonable grounds to believe that proceeding would expose Mango Monkeyz or another person to fraud or loss.

5. CASH ON DELIVERY ORDERS

Cash on Delivery (“COD”) is offered at Mango Monkeyz's discretion and may not be available for every order, customer, PIN code or order value.

We may require COD orders to be confirmed through methods such as:

  • OTP;

  • WhatsApp;

  • SMS;

  • telephone;

  • email; or

  • another reasonable verification method.

Repeated refusal of confirmed COD orders, repeated non-acceptance of deliveries, fake orders, deliberately incorrect addresses or other patterns reasonably indicating COD misuse may result in COD being restricted for future orders.

Mango Monkeyz may require future orders associated with such activity to be prepaid.

6. FRAUDULENT, FAKE OR ABUSIVE ORDERS

Mango Monkeyz has zero tolerance for deliberate e-commerce fraud.

Examples of suspected fraudulent or abusive behaviour may include:

  • knowingly placing fake orders;

  • deliberately providing false delivery information;

  • impersonating another person;

  • placing orders without genuine intention to accept delivery;

  • manipulating payment systems;

  • attempting unauthorised transactions;

  • false missing-item claims;

  • false non-delivery claims;

  • product substitution;

  • return substitution;

  • tag swapping;

  • deliberate product damage followed by a false defect claim;

  • knowingly submitting fabricated photographs/videos;

  • knowingly making false representations to obtain a refund;

  • attempting to retain both the merchandise and refunded money;

  • abusing promotional codes;

  • creating multiple accounts to circumvent promotion limits;

  • repeated chargebacks without legitimate grounds;

  • using stolen or unauthorised payment credentials; or

  • any other deliberate attempt to obtain products, refunds, credits or benefits through deception.

Where we reasonably suspect such activity, we may conduct additional verification and, where permitted by applicable law:

  • place an order on hold;

  • cancel an order;

  • restrict COD;

  • restrict discretionary returns or exchanges;

  • suspend or restrict an account;

  • prevent further transactions;

  • preserve relevant records;

  • contest fraudulent payment disputes or chargebacks; and/or

  • exercise other rights or remedies available under applicable law.

Nothing in this section limits the rights of genuine consumers to raise legitimate complaints, payment disputes, return requests or claims.

7. CHARGEBACKS & PAYMENT DISPUTES

If you believe a transaction is incorrect, unauthorised or otherwise disputed, we encourage you to contact Mango Monkeyz customer support so that we can investigate.

Where a chargeback or payment dispute is initiated, Mango Monkeyz may provide relevant transaction records to the applicable bank, card network, UPI/payment service provider, payment gateway or other authorised party handling the dispute.

Such records may include, where lawfully available:

  • order information;

  • payment information;

  • order confirmation;

  • shipping records;

  • courier tracking;

  • proof of dispatch;

  • proof of delivery;

  • customer communications;

  • return records;

  • refund records;

  • account/order activity; and

  • other evidence reasonably relevant to the dispute.

Mango Monkeyz reserves the right to contest chargebacks or payment disputes that we reasonably believe are fraudulent, inaccurate or inconsistent with documented transaction records.

8. PRICING

All prices displayed on the website are shown in Indian Rupees (₹) unless stated otherwise.

Applicable taxes, shipping charges, COD charges or other charges, where applicable, will be disclosed as required before completion of the transaction.

We make reasonable efforts to ensure that product prices are accurate.

However, genuine technical, typographical or system errors may occasionally occur.

If an obvious pricing error is identified before fulfilment, we may contact the customer and provide an appropriate option, including cancellation and refund where applicable.

Mango Monkeyz will not intentionally use misleading pricing practices.

9. PROMOTIONS, DISCOUNTS & COUPON CODES

Promotional offers and discount codes may be subject to separate conditions displayed with the promotion.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;

  • promotional codes may have expiry dates;

  • certain products may be excluded;

  • multiple discounts may not be combinable;

  • an offer may be limited to one use per customer/order; and

  • promotional benefits may be reversed where the underlying transaction is legitimately cancelled or refunded.

Mango Monkeyz may cancel or refuse a promotional benefit where there is reasonable evidence of manipulation, technical exploitation, multiple-account abuse or other fraudulent use.

Any such restriction will remain subject to applicable consumer law.

10. PRODUCT INFORMATION

We make reasonable efforts to display accurate information regarding our products, including:

  • photographs;

  • colours;

  • designs;

  • materials;

  • measurements;

  • sizing;

  • fit;

  • descriptions; and

  • prices.

However, the appearance of colours may vary depending upon your device, screen settings, brightness and lighting.

Minor manufacturing variations may also occur between production batches.

Such reasonable minor variations will not ordinarily constitute a product defect unless they materially affect the product's quality, functionality or advertised characteristics.

11. SIZING

Customers are encouraged to review the Mango Monkeyz size guide before placing an order.

Age references are intended as general guidance because children's measurements and body proportions vary.

Where measurements are provided, we recommend using the child's actual measurements when selecting a size.

Size-related exchanges are governed by our Return, Exchange & Refund Policy.

12. PRODUCT AVAILABILITY

All products are subject to availability.

Placing a product in your shopping cart does not permanently reserve that inventory.

In rare cases, an item may become unavailable after an order is placed because of simultaneous purchases, inventory discrepancies, damage identified during quality checking or another operational issue.

If we cannot fulfil a prepaid item, we will provide an appropriate refund or other option in accordance with applicable law.

13. DELIVERY

Delivery estimates shown on our website are estimates unless expressly stated otherwise.

Delivery may occasionally be affected by circumstances beyond our reasonable control, including:

  • courier disruptions;

  • severe weather;

  • natural disasters;

  • strikes;

  • government restrictions;

  • transport disruptions;

  • incorrect customer information;

  • inaccessible delivery locations; or

  • other force majeure events.

We will nevertheless comply with obligations imposed upon us by applicable consumer law.

14. DELIVERY RECORDS

For fraud prevention, customer support and dispute resolution, Mango Monkeyz may rely upon appropriate records provided by our logistics partners, including:

  • tracking information;

  • delivery scans;

  • delivery timestamps;

  • delivery status;

  • OTP-based confirmation where used;

  • proof-of-delivery information; and

  • other relevant courier records.

Such records may be considered together with all other available evidence when investigating a delivery dispute.

Courier records will not automatically override credible evidence demonstrating that an order was not properly delivered.

15. RETURNS, EXCHANGES & REFUNDS

All returns, exchanges and refunds are governed by our separate Return, Exchange & Refund Policy, which forms part of these Terms.

Returned merchandise may undergo verification and quality inspection before an exchange or refund is approved, where permitted under applicable law.

Mango Monkeyz reserves the right to investigate suspected return fraud, including product substitution, tag manipulation, use-and-return activity, deliberate damage and false missing-product claims.

16. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the Mango Monkeyz website and its original content are owned by or licensed to Mango Monkeyz.

This includes, where applicable:

  • Mango Monkeyz name;

  • logos;

  • mascot and characters;

  • clothing graphics;

  • illustrations;

  • artwork;

  • prints;

  • slogans;

  • product designs;

  • photographs;

  • videos;

  • website graphics;

  • packaging designs;

  • marketing campaigns;

  • written content; and

  • other original creative materials.

Applicable intellectual-property rights are reserved.

Nothing on this website grants any person a licence to commercially reproduce, copy, manufacture, distribute or exploit Mango Monkeyz intellectual property except with our prior written permission or as otherwise permitted by law.

17. PROHIBITED COMMERCIAL COPYING

You must not, without appropriate permission:

  • reproduce our original artwork for commercial purposes;

  • copy our original clothing graphics for manufacturing;

  • commercially reproduce our photographs;

  • copy our original packaging designs;

  • use our trademarks or branding to falsely suggest association with Mango Monkeyz;

  • sell counterfeit Mango Monkeyz products; or

  • falsely represent another product as an original Mango Monkeyz product.

Mango Monkeyz reserves all rights and remedies available under applicable intellectual-property and other laws.

18. WEBSITE CONTENT & SCRAPING

You may use our website for legitimate personal shopping and browsing.

You may not use automated systems to access, extract or reproduce website content in a manner that violates applicable law or our intellectual-property rights, disrupts the website, circumvents security measures or is undertaken for fraudulent purposes.

Unauthorised commercial reproduction of our product catalogue, photographs, descriptions or other proprietary content is prohibited to the extent permitted by law.

19. PROHIBITED WEBSITE USE

You must not knowingly:

  • introduce viruses or malicious code;

  • attempt to compromise website security;

  • attempt unauthorised access to another customer's information;

  • interfere with checkout or payment systems;

  • exploit technical vulnerabilities;

  • use bots to manipulate promotions or inventory;

  • conduct fraudulent transactions;

  • impersonate another person;

  • submit knowingly false information;

  • use the website to violate applicable law; or

  • interfere with the proper operation of our store.

We may restrict access where reasonably necessary to protect our website, customers or business from such activity.

20. CUSTOMER ACCOUNTS

Where customer accounts are available, you are responsible for maintaining the confidentiality of your account credentials.

Please notify us promptly if you reasonably believe that your account has been accessed without authorisation.

We may temporarily restrict an account where reasonably necessary to investigate suspected unauthorised access or fraud.

21. REVIEWS & USER-SUBMITTED CONTENT

If you submit a review, photograph, comment, testimonial or other content to Mango Monkeyz, you confirm that you have the right to submit that material.

You must not knowingly submit content that:

  • is fraudulent;

  • impersonates another person;

  • infringes third-party intellectual-property rights;

  • contains unlawful material;

  • contains malicious code; or

  • deliberately misrepresents a transaction.

We may moderate or remove user-submitted content where reasonably necessary and legally permissible.

Nothing in these Terms prevents customers from posting genuine criticism, reviews or complaints about Mango Monkeyz.

22. SOCIAL MEDIA & IMPERSONATION

Mango Monkeyz may maintain official social-media accounts.

Customers should exercise caution regarding fake accounts, fraudulent advertisements, impersonators and phishing communications claiming to represent Mango Monkeyz.

Mango Monkeyz will not knowingly request sensitive payment credentials such as card PINs, UPI PINs or banking passwords through ordinary social-media messages.

If you receive suspicious communications claiming to represent Mango Monkeyz, please contact our official customer-support channel.

23. THIRD-PARTY SERVICES

Our website may use third-party services including Shopify, payment gateways, logistics providers, analytics services and other technology providers.

Certain transactions may therefore also be subject to the applicable third party's terms and privacy practices.

Mango Monkeyz is not responsible for independent third-party services to the extent permitted by applicable law, but nothing in this clause excludes any responsibility that cannot legally be excluded.

24. PERSONAL INFORMATION

Personal information collected through our store will be handled in accordance with our Privacy Policy and applicable Indian law.

Information may be processed where reasonably necessary for purposes including:

  • fulfilling orders;

  • processing payments;

  • arranging delivery;

  • customer support;

  • processing returns/refunds;

  • resolving disputes; and

25. FRAUD PREVENTION RECORDS

Where permitted under applicable law, Mango Monkeyz may retain appropriate transaction and fulfilment information for legitimate purposes including fraud prevention, accounting, legal compliance and dispute resolution.

Relevant information may include order history, payment status, delivery history, return history and customer communications.

Where fraud or unlawful activity is reasonably suspected, relevant information may be shared with payment providers, logistics providers, professional advisers, governmental authorities, law-enforcement agencies, courts or other competent authorities where legally permissible or required.

26. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable Indian law.

To the extent permitted by law, Mango Monkeyz will not be liable for losses caused solely by:

  • misuse of products contrary to provided instructions;

  • unauthorised modification of products;

  • customer-provided incorrect information;

  • unauthorised access resulting from a customer's failure to reasonably protect their credentials;

  • third-party systems outside our reasonable control; or

  • events outside our reasonable control.

This clause shall not limit statutory consumer remedies relating to defective products, deficient services, negligence or other liabilities that cannot legally be excluded.

27. INDEMNIFICATION

To the extent permitted by applicable law, a user may be responsible for losses reasonably arising from their deliberate unlawful or fraudulent use of the Mango Monkeyz website, infringement of Mango Monkeyz's rights, or material violation of these Terms.

This clause is not intended to impose unreasonable liability upon consumers or restrict statutory consumer rights.

28. SUSPENSION OR TERMINATION OF ACCESS

Mango Monkeyz may suspend or restrict website/account access where reasonably necessary because of:

  • fraud;

  • security threats;

  • unlawful activity;

  • repeated material violations of these Terms; or

  • misuse of our systems.

Such action does not affect any statutory rights relating to legitimate orders already placed.

29. GOVERNING LAW

These Terms and transactions with Mango Monkeyz shall be governed by the laws of India.

Subject to mandatory consumer-protection laws and any statutory right of a consumer to approach a competent consumer commission, court or authority having jurisdiction, disputes relating to these Terms shall be subject to the jurisdiction of competent courts at Delhi, India, where legally permissible.

Nothing in this provision is intended to restrict a consumer from exercising jurisdictional rights available under applicable consumer law.

30. CONSUMER PROTECTION

These Terms are intended to operate consistently with applicable Indian law, including, where applicable:

  • the Consumer Protection Act, 2019;

  • the Consumer Protection (E-Commerce) Rules, 2020;

  • the Information Technology Act, 2000; and

  • other applicable laws, rules and regulations.

Nothing contained in these Terms is intended to waive or restrict mandatory statutory rights available to consumers.

If a provision of these Terms conflicts with a mandatory provision of applicable law, the applicable law shall prevail to the extent of that conflict.

Changes will apply prospectively as required by applicable law and will not be used to retrospectively remove rights that had already accrued to a consumer.

33. SEVERABILITY

If any provision of these Terms is held by a competent authority to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

34. NO WAIVER

If Mango Monkeyz does not immediately enforce a provision of these Terms in a particular instance, this will not automatically constitute a permanent waiver of that provision or of our legal rights.

35. ENTIRE AGREEMENT

These Terms, together with the policies incorporated into them, constitute the terms governing your use of the Mango Monkeyz online store and purchases from us, subject always to applicable law.
